1 - INTRODUCTION

These sales conditions (hereinafter called “General Conditions”) regulate the sale of products marketed by www.estorehouse.it. All sales contracts of products concluded through the website www.estorehouse.it according to the procedures indicated therein, between the Seller and the Customer, will be regulated by these General Conditions.


2 - ACCEPTANCE OF THE SALES CONDITOINS

1 - The contract stipulated between Store 2.0 and the Customer should bbe considered terminated with acceptance, even partial, of the order by Store 2.0 srl , who reserves the right, in his own discretion, to accept the order.

Acceptance of the order is considered tacit, unless communicated using any method to the Customer. By placing an order according to the various methods indicated, the Customer declares that he has read all of the indications providing during the purchase procedure and accepts all of the general and payment conditions indicated herein.

2 - If the Customer is an end-user (therefore an individual who is buying the goods for objectives that have nothing to do with his professional activities), once the purchase procedure has been terminated, he will print or save an electronic copy and, in any case keep, these general sales conditions in compliance with the indications of articles 3 and 4 of the Legislative Decree n. 185/99 regarding remote sales.

3 - The Customer will have no right to compensation for damages or compensation as well as any contractual or non-contractual responsibility related to direct or indirect damages to people and/or things, caused by non acceptance, even partial, of an order.


3 - PURCHASE METHODS

1 - The Customer may only purchase the products included in the online catalogue of Store 2.0 srl when placing the order and viewable at the website www.estorehouse.it as described in the relative informative details. The technical information included in the website www.estorehouse.it provide a faithful reproduction of the articles included in the catalogue.

Store 2.0 srl, therefore, reserves the right to modify the technical information of the products without the need to provide any notice whatsoever. It is understood that the image provided alongside the description of the product may not necessarily be a perfect representation of its characteristics and may differ in terms of colour, size and accessories illustrated.

All of the information provided to support the purchase (Description, Size guide etc) should be considered purely as general informative material, and not referable to the real characteristics of each single product.

2 - Correct receipt of the order will be confirmed by Store 2.0 srl by an email sent to the email address indicated by the Customer. This confirmation message will indicate the Date and time of receipt of the order and a ‘Customer Order Number’ to be indicated in all correspondence with Store 2.0 srl.

The message will include all details inserted by the Customer, who undertakes to check their accuracy and immediately communicate any possible corrections according to the methods described in this document. Furthermore the Customer may check the status of his order by logging into his profile on the website, “Order status”.

3 - In the case of refusal of an order, Store 2.0 Srl undertakes to inform the Customer immediately.

4 - All of the prices indicated in the website should be considered as prices to the public and, therefore, do not include any customs clearance costs for delivery to countries outside of the European Union. Store 2.0 srl reserves the right to modify prices at any time, without any notice. If an incorrect and/or clearly negligible price is published, for any reason whatsoever (an error in our systems, human error etc), the order will be cancelled even if initially confirmed.

 5 - The website www.estorehouse.it illustrates the quantity of products available when an order is placed. As contemporary access of many users-customers and the contemporary possibility of on-line orders modifies product availability, Store 2.0 srl does not guarantee the certainty of assignment of the goods ordered.

 6 - For some products, part of a price promotion, Store 2.0 srl reserves the right to accept orders by reducing the quantity, prior to communication and acceptance by the Customer, failing which the order will be considered cancelled.


4 - E MEMBER

Being an EMember of the website www.estorehouse.it means having access to privileges (promotions, discounts, events...). Guest customers will not be able to take advantage of such privileges and therefore will not be able to see the discounts on the website.

How

In order to become an EMember you must place at least one order in one of our stores belonging to the group (see the list here) or on the website www.estorehouse.it . You will then receive an email with your credentials or you can recover them at any time from the website by inserting the data providing during the acquisition phase (in the recover password form).

Reserved Area

By accessing the reserved area you can see the exclusive discounts available through EMember price and, furthermore, you will receive all promotions and discounts available to you. Remember that you do not log in before the purchase you will not be able to see the discounts. Accessing the EMember area is vital!


5 - PAYMENT METHODS


Payment methods

Our online shop accepts payment using Credit Card, Scalapay, Satispay e Paypal. You can choose the method of payment that you prefer at the end of the purchase process.

Cash payment is not currently available, directly or through the post office.

NB: This online shop operates from the European Union and all transactions are carried out in Euro (unless otherwise specified). If you pay with any other currency, currency conversion will be based on the exchange rate on the day in which the order is placed. No additional costs are calculated for currency conversion.


Credit cards

On the website www.estorehouse.it your payment is completely safe using any credit card that is part of the VISA or Mastercard circuits.

The amount will be authorised on your card when you proceed with checkout and after confirmation by your bank.

Store 2.0 Srl reserves the right to request additional information from the Customer, such as an ID card proving ownership of the Card used. If the document requested is not presented, Store 2.0 srl reserves the right not to accept the order.

This operation may therefore affect delivery times of the order.

At no time whatsoever after the purchase procedure will Store 2.0 srl be able to acquire the information related to the credit card of the buyer, as details are inserted directly in the website of the bank that deals with the transaction (with extremely high safety systems): as there is no data transmission, these details cannot be intercepted. No computer archives of Store 2.0 srl contain or keep such data.

In no case will Store 2.0 Srl be held responsible for any possible fraudulent and illegal use of credit cards by third parties, during payment of products purchased on www.estorehouse.it


Satispay

With the application of Satispay you can pay your purchases quickly by scanning the QR code or by inserting your mobile phone number.

For purchases carried out using the Satispay payment method, upon conclusion of the on-line transaction, Satispay will immediately debit the amount of the purchase made.

In the case of cancellation of an order, the amount of the cancelled goods will be transferred back to the Satispay account of the customer. Transfer times depend exclusively on Satispay.

Store 2.0 Srl reserves the right to request additional Customer information (for example, a land line number) in order to establish the effective ownership of the Satispay account. If the document requested is not presented, Store 2.0 Srl reserves the right not to accept the order.

At no time whatsoever after the purchase procedure will Store 2.0 Srl be able to acquire the information related to the Satispay account of the buyer. Therefore, in no case whatsoever, can it be held responsible for any fraudulent and illegal use of the account.

The order cannot be cancelled by the customer as the goods, if available, are dispatched immediately.

Scalapay

Scalapay is a modern payment method that allows customers to purchase from on-line shops and in stores, receive the products immediately and pay in 3 convenient instalments on a monthly basis.

If you buy with Scalapay you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their assignees, and that you authorize this transfer.

This service has no extra cost if the instalments are paid by the expiry date.

When the purchase is completed the first instalment (equivalent to one third of the total value of the order) will be charged immediately. The following 2 instalments will be charged on a monthly basis.

First instalment: when the purchase is made

Second instalment: one month from the purchase date

Third and last instalment: 2 months from the purchase date.

PayPal

PayPal is a safe, easy, fast and cheap on-line payment system.

SAFE: your credit card details or details of your Paypal account are only kept by Paypal and it is not necessary to insert details again when you make an order.

EASY: with two simple clicks, you can make an order. All of the details have already been inserted in the PayPal account previously created.

FAST: payment will be sent immediately to Store 2.0 Srl.without any further steps to be carried out.


6 - SHIPMENTS


Information on delivery

Store 2.0 srl will only accept orders for delivery within Europe and Switzerland.

In order to guarantee fast delivery of your order, the shop www.estorehouse.it uses the services of selected express couriers according to the destination and type of product.

Delivery costs will be borne by the Customer and are clearly indicated when placing your order. Payment of the goods by the Customer will be carried out using the method chosen during the order procedure. No further costs or commission will be due to Store 2.0 Srl, but the Customer will pay for all customs taxes if the goods are delivered to non EU countries, as specified in “Taxes and customs duties”.

The prices indicated represent an estimate and may vary according to the sizes of the box. The final price will be shown in the cart and it will be charged together with the cost of your order during finalisation of payment.

Order processing time

Orders will be processed from 9.00 to 17.00 GMT from Monday to Friday. Orders placed after 17.00 on Friday will be processed the day after.


Track your order

In order to check information regarding your order, you will receive a tracking by email so you can check and following the status of your shipment.


Shipping times

All orders shipped within Italy will be delivered within 1 to 2 working days from the shipment date.

All orders shipped to special regions and/or islands and the rest of the European Union require approximately 3 to 4 working days from the shipment date.

These times may vary due to unexpected events or due to traffic conditions and circulation in general or due to Authorities.

Store 2.0 Srl will not be held responsible in the event of a delay in the shipment of an order or delivery of the goods ordered.

When the courier delivers the goods, the Customer is obliged to check:

- that the number of packages delivered corresponds to the number indicated in the invoice;

- that packaging is intact, not damaged or wet or modified in any way.

Any external damages or if the number of packages or indications do not correspond, should be immediately communicated to the courier that has made the delivery and the Customer should indicate “accepted with reservation” on the relative transport document. In the case of a damaged package, write “accepted with reservation because the package is damaged”. Further the Customer should open a complaint with Store 2.0 srl, contacting the email addresses indicated in the Contacts section.

Once the courier document has been signed, the Customer will not be able to make any form of complaint regarding the external characteristics of the package received.

Shipping Costs

Shipping costs are clearly indicated on each article and are based on a weight/volume calculation defined with the courier in charge of delivery. Store 2.0 srl reserves the right to modify the shipment costs without any notice if conditions of use and contracts vary with the various carriers. Store 2.0 srl may organise a sales campaign with free transport costs, without this compromising the possibility for Store 2.0 srl to request a contribution from the Customer for packaging and transport costs.


Customs costs and duties

Non EU countries

Shipments to destinations outside of the European Union will be subject to import duties or customs duties. These costs will be borne exclusively by the recipient who will pay the amount due to the forwarder or to relative authorities.

Absence of customs clearance

In order to guarantee that the package is cleared through customs, the Customer will provide all necessary information and/or pay all relative duties. If the package is not cleared through customs, it will be returned to our warehouse. For further information please consult our Returns policy.


7 - RETURNS


The return policy

If you change your mind, you can return a product within 30 days from the delivery date.

Reimbursement will be issued after our quality control team has assessed the product. You may have to wait about two weeks from when you return the article to when we confirm that the return has been accepted.

Any returns should not be worn, washed or modified in any way. They should still have their original label and be in their original packaging.

In order to return an article, complete the online Return procedure (see the section “How to make a Return” for further details).


How to return or change an article

1. Complete the return/change procedure on-line by logging into your account and clicking on “History and order details”. Click on “Details” alongside your order number and select the product that you want to return. Tell us the reason for this change/exchange, perhaps you want to change the size or you want your money back and click on “send return/exchange request”.

2. Book pick-up using the website, put the article back in its original packaging and/or make sure that it has been correctly packed. You will receive a waybill and the courier will inform you of when the package will be collected.

3. Once we receive the returned article, our team will assess its integrity and will make the exchange or reimbursement as requested.

In the case of an exchange, the cost of the return will be borne by the Customer according to the “Return dispatch Costs” while costs for delivery of the new article will be borne by Store 2.0 srl, excluding any possible promotions connected with the dispatch service.

The returns right will no longer be valid, due to the absence of the essential condition of integrity of the article (package and/or its contents), if Store 2.0 Srl finds:

- that the product has been damaged, damage not caused by transport;

- that the product is dirty because it has been worn, therefore compromising its integrity.

Costs and risks related to transport for returns will be borne entirely by the Customer. The return of products that are not perfectly intact or are deteriorated will not be accepted by Store 2.0 Srl and will be returned to the sender who will also be charged for transport costs.

In the case of decadence of the withdrawal right, Store 2.0 Srl will return the article purchased to the sender, charging him for all dispatch costs.


Dispatch Costs of Returned goods

If you want to return an article, dispatch costs to our warehouse will be paid entirely by you. The dispatch cost will be deducted from the amount to be reimbursed according to the costs illustrated in the “Dispatch” section.


Reimbursements

How to request reimbursement

You can request reimbursement by returning the product within 30 days from the delivery date. Make sure that you have read our returns Policy, then return the product by following our instructions.

Amount of reimbursement

Administrative costs of the reimbursement will be borne by the shop. On the contrary, all dispatch costs related to the product will be borne by the Customer. Therefore you will receive full reimbursement of the value of the products returned, net of any transport costs.

We reimburse:

- the cost of the products;

The reimbursement will not include:

- transport cost for return of the article, at the standard dispatch rate as indicated in the section “Dispatches”

Reimbursement times

We remind you that your reimbursement will only be issued following approval by our Quality Control team. This is our way of making sure that you are always satisfied with your purchases on www.estorehouse.it. Please note that approximately 14 days may pass from when you return the article to when we confirm that the return has been accepted. Furthermore, we must also remind you that for orders paid by Credit Card, reimbursements may take up to 4 weeks before you see them on your bank statement, as times depend on bank services.

If you have a problem with the product received, we kindly invite you to contact our Customer Service: we will offer you an adequate solution.


8 - WARRANTY

All of the products sold by Store 2.0 Srl are covered by a conventional warranty of the manufacturer in accordance with the Legislative Decree n. 24/02. In order to take advantage of the warranty assistance, the Customer should keep the purchase document received with the goods and/or by email. The Customer may download all documents from the website www.estorehouse.it through the reserved area.


9 - COMPLAINTS

10 - INTELLECTUAL PROPERTY

The website www.estorehouse.it and its contents are protected by norms related to intellectual and industrial property rights. Consequently, all forms of reproduction, communication, distribution, publication, alteration or transformation of the contents of the website are prohibited in any form and for any reason unless specifically authorised byStore 2.0 Srl.

The brands and images on the website refer to products sold and remain the property of the respective owners and are used in the website with the sole objective of describing, representing and promoting the goods on sale.

Store 2.0 srl owns the Store House Brand and the website estorehouse.it.


11 - JURISDICTION AND APPLICABLE LAW

The sales contract between the Customer and Store 2.0 srlis considered concluded in Italy and regulated by Italian Law and in particular by the Legislative Decree n. 206 of 6th September 2005 (the Consumer Code). For the solution of civil and penal controversies deriving from the conclusion of this remote sales contract, if the Customer is a consumer, territorial competence will be the court legally responsible in his city of residence; in all other cases, territorial competence will be exclusively Lodi.
